PRIVACY NOTICE INTEGRAL

This Privacy Notice is issued in compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “Law”), its regulation (the “Regulation”) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (known as the “GDPR”).

DE C.V.  with address Street Dulce Oliva No. 157 B No. Int Office D, colonia Villa Coyoacán, Alcaldía Coyoacán, C.P. 04000, Mexico City, Mexico, as well as its subsidiaries, affiliates or the same business group (hereinafter “AAA ARENA CANCÚN”) is the company responsible for the use and protection of your personal data and, in this regard, informs THE HOLDER about its personal data processing policies and security measures in accordance with the provisions of this notice. 

II. PURPOSE OF THE NOTICE: The purpose of this privacy notice is to inform all the person who provides their data to AAA ARENA CANCÚN (Hereinafter “THE HOLDER”), About the policies you follow AAA ARENA CANCÚN to collect personal data, carry out a correct treatment for the main and secondary purposes established herein, the care measures you take to maintain the confidentiality of your personal data and the mechanisms you make available to answer queries related to your rights of access, rectification, cancellation and opposition (known as “ARCO rights”).

PERSONAL DATA THAT WILL BE COLLECTED: The personal data we collect are the following: name, nationality, date of birth, address, city and country of residence, telephone number(s), email, photograph, occupation and company for which you work, names on social networks (Facebook, Twitter, Instagram, Snapchat and any other current or future social networks) and the banking information of your debit or credit cards, or other forms of payment such as PayPal, that have been used by THE HOLDER for the contracting of the products or services offered by AAA ARENA CANCÚN. 

In case THE HOLDER Access the https://luchatitlan.com/ website  or profiles of AAA ARENA CANCUN in social networks (Facebook, Twitter, Instagram, Snapchat and any other current or future social network) will also be collected the following data: IP address, type of Internet browser, browsing preferences on our website, Internet pages you visit. The protection of the privacy of the personal data of minors, are especially important for AAA ARENA CANCUN, reason why, as soon as we become aware of personal data of minors, its treatment will be carried out complying at all times with the guidelines and requirements established in the Law and Regulations. a) The management of reservations, purchases of products or services, the quotation of events and in general customer service.

b) The identification and access of THE HOLDER to the facilities of AAA ARENA CANCÚN where the services are provided.

c) The provision of customer services, through chats, email, telephone or other means.

d) The collection, use, management, storage and development of a database of customers and people related to AAA ARENA CANCÚN, as well as the activities aimed at maintaining and updating the database, which allows to offer a better service.

e) The collection and billing of the products and services offered by AAA ARENA CANCÚN.

f) Evaluate the quality of the products and services offered by AAA ARENA CANCÚN.

1. EXERCISE OF ARCO RIGHTS: THE HOLDER is informed  that, in compliance with the provisions of the Law and its Regulations, he has the following rights:

I. Access: You have the right to  request from AAA ARENA CANCÚN a report on the personal data that was collected, the treatment given to it and the conditions of use. In exercising this right, you may request an electronic copy of such information.

II. Rectification: You have the right to  request AAA ARENA CANCUN the correction of your personal information in case it is outdated, inaccurate or incomplete.

a) Cancellation: You have the right to request that your personal data be deleted from the records or databases of AAA ARENA CANCÚN when they are not being used for the purposes for which it was collected or when their treatment does not comply with the principles, duties and obligations provided for in the regulations.

b) Opposition: You have the right to ask AAA ARENA CANCUN not to  use (or stop using) your personal data for specific purposes.

For the exercise of these rights, THE HOLDER must  submit,  personally or  through a legal representative with specific powers, a written request or email addressed to  the person in charge of processing personal data, described in the immediately previous point and must contain the following information:

i. The name of THE HOLDER and address or other means to communicate the response to your request;

ii. The documents that prove your identity or, where appropriate, your due legal representation;

iii. The clear and precise description of the personal data with respect to which one seeks to exercise any of the aforementioned rights;

iv. Any other element or document that facilitates the location of personal data; and

v. In the case of rectification requests, you must indicate the modifications to be made and provide the documentation that supports your request..

Any application that does not meet these requirements may be rejected by AAA ARENA CANCUN until it is corrected..

Requests that meet the above requirements will be dealt with within 20 business days of the date the request was received. In the event that the request is appropriate, AAA ARENA CANCÚN will make its compliance effective within 15 business days following the date on which it has communicated its response to THE HOLDER. The time limits described herein may be doubled only once when the circumstances of the case so warrant.

En In the event that, for any justified cause established in the Law or the Regulations, it is not possible to comply with the request, AAA ARENA CANCÚN must communicate to THE HOLDER its total or partial refusal informing the reason for its decision, accompanying the evidence that is pertinent. 

VII. REVOCATION OF CONSENT TO THE USE OF YOUR PERSONAL DATA: THE HOLDER is informed that he may revoke, totally or partially, his consent for the use of his personal data in case he considers that they are used for purposes other than those for which they were collected. To do this, you must submit an application in accordance with the requirements, procedure and deadlines established in numeral XI.  Of nominee “EXERCISE OF ARCO RIGHTS”. 

The deletion of personal data will result in a blocking period after which the data will be deleted. AAA ARENA CANCÚN may keep personal data exclusively for the purposes of the responsibilities arising from the treatment. The blocking period will be equivalent to the limitation period of the actions derived from the legal relationship that bases the treatment in the terms of the applicable Law in the matter. Once the data has been canceled, notice will be given to THE HOLDER..

COMPLIANCE WITH PROVISIONS OF THE EUROPEAN UNION GDPR: In the event that THE HOLDER is a national or resident of the European Union, you are informed that AAA ARENA CANCÚN, in compliance with the provisions established by the RGPD,  has taken various measures for the protection of your personal data, mentioning among them the following:

1. The recognition of additional rights: In accordance with the provisions of the GDPR, AAA ARENA CANCÚN recognizes the following rights of THE HOLDER:

I. Right of limitation of  treatment: It is the right  of THE HOLDER to obtain AAA ARENA CANCUN the limitation of the processing of their data in the following cases :

Where the accuracy of the personal data is contested, for a period of time to verify their accuracy;
When its treatment is illegal and THE HOLDER opposes the deletion and instead requests the limitation of its use;
When AAA ARENA CANCÚN no longer needs the personal data for the purposes of the treatment, but THE HOLDER needs them to formulate or exercise their rights.
When THE HOLDER  has opposed its treatment, while verifying if the legitimate reasons  of AAA ARENA CANCÚN prevail over those of THE HOLDER .

In such cases, AAA ARENA CANCÚN may only continue the processing of personal data with the consent  of THE HOLDER or  in any of the exceptions established by Law, Regulation or RGPD.

Right to data portability: It is the right to receive the personal data that concern you, which you have provided  to AAA ARENA CANCÚN, in a structured, commonly used and machine-readable format, and to transmit them to another data controller when the treatment is carried out by automated means.

II. Right to automated individual decisions: It  is the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects on it or significantly affects you in a similar way, unless it is necessary for the provision of the services that AAA ARENA CANCÚN offers.

The rights referred to herein may be exercised, when applicable, in accordance with the requirements, the procedure and the deadlines established in numeral XI.  ofnominee  “EXERCISE OF ARCO RIGHTS”. 

a) Registration of data processing activities: In accordance with the provisions of the GDPR, AAA ARENA CANCÚN undertakes to enter into a contract with the person in charge of the treatment, indicated in numeral X. ofnominated “PERSON IN CHARGE OF DATA PROCESSING”, WHO WILL HAVE THE OBLIGATION TO KEEP A RECORD OF THE TREATMENT ACTIVITIES CARRIED OUT UNDER HIS RESPONSIBILITY IN ACCORDANCE WITH THE PROVISIONS OF THE RGPD .

AUTORIDAD DE CONTROL: THE HOLDER is informed  that, for the attention of any complaint or claim related to this notice, which has not been duly attended  by AAA ARENA CANCÚN within the deadlines and forms established in this notice, you may go to the National Institute of Transparency, Access to Information and Protection of Personal Data (by its acronym “INAI”). Inquiries to this authority can be directed to the telephone 018008354324, al correo electrónico [email protected] o in writing to the address located at: Av. Insurgentes Sur, # 3211, Ground floor, Colonia Insurgentes Cuicuilco, Delegación Coyoacán, C.P. 04530, Mexico City.

IX. SECURITY MEASURES: THE HOLDER is informed that AAA ARENA CANCÚN will take reasonable organizational and technical security measures to prevent the loss, misuse, alteration or illegal disclosure of their information and personal data, which we require to be complied with by the service providers they hire, including in the case of services provided by subsidiary companies,   affiliates or the same business group of AAA ARENA CANCUN. 

Among the security measures that AAA ARENA CANCUN may take for the care of your personal information are the following:

a. Restrict the access of its personnel to the physical or digital databases where the personal data collected is recorded.

b.  The use of keys, passwords and document encryption for physical and digital files where personal data is stored.

c.  Using antivirus and firewalls to prevent unauthorized access by hackers.

d. Any other security measures it deems appropriate.

In case of a violation of security measures, AAA ARENA CANCÚN undertakes to take the necessary measures to  evaluate the impact of the violation and take the necessary measures to compensate for the damage caused to its security system.
